How long can we keep data? – Understanding data retention rules

There is often a tension between the length of time that an organisation would like to keep data, and the length of time that the law seems to allow.

Data protection rules require that personal data must not be kept for longer than is necessary for the purposes for which the data are processed. But how do you determine how long that is for each different type of data that your organisation holds?

This highly practical training course, which includes instruction on the provisions of the upcoming EU General Data Protection Regulation as well as the implications of Brexit, provides delegates with everything they need to handle the setting of appropriate data retention periods in their own organisations. It covers:

  • data retention rules – what they mean and what they require
  • the legal and commercial risks of non-compliance with data retention requirements
  • how to assess appropriate time periods for the various types of data that your organisation holds
  • the significance of the Google Spain case
  • action taken by data protection regulators for non-compliance
  • ‘deleting’ and ‘archiving’ personal data – what are the differences?
  • how to draft an effective data retention policy and schedule, and how to promote and communicate it internally
  • necessary contractual provisions for external companies that handle your data
  • guidance for fostering a culture of effective compliance
  • the likely future of data retention, including upcoming changes to the rules
